I'm not sure what "intellecutal property law" the article is referring to. It sounds like a "right of publicity" type of claim, which varies from state to state. But this type of claim is a stretch b/c an athlete's stats is far away from his identity and probably should not be protected. As for policy, I don't think such information should be considered property. I'm surprised it is being licensed at all today. Finally I think MLB is actually helped by the fantasy fans out there. MLB is too greedy.

Shouldn't INS v. AP have something to say about this?

I basically agree with everything else said by above poster--if baseball stats are right of publicity, then that particular area of law is getting even more out of control.

people want to monetize every last bit of information on the planet and if someone can't, they sue. it's ridiculous.
