American military casualties in Iraq hit 3500 this week. The incoming Chairman of the Joint Chiefs of Staff may not be a yes-boy to anything out of the White House like his predecessor, but then he thinks this is some sort of a "generational war." Borderline xenophobia and bigotry have derailed a comprehensive immigration bill.
Yet what do I want to talk about? Paris. I hate her. A lot. She's talentless, not that attractive, but plenty annoying. Frankly, if I was a bit tougher on crime, I would consider those enough reasons to lock her up. But I have to part ways with Judge Sauer's decision to remand her back to jail. Breaking probation (repeatedly) is no laughing matter. And frankly the whole cooked up bull shit about a "medical condition" (see speculation here) just made things worse. But she shouldn't be in jail.
Frankly I'm pissed off that Sheriff Baca is equivocating on his decision. Damn it you're in charge of protecting the citizens of the largest county in the largest state. Act like it. I don't need to dig up crime statistics to figure out the number of violent offenses committed in LA County on a daily basis. Yeah it's nice to send a message to a celebrity that all the dollars in the world can't get you out of a few nights in the slammer. But even if this was Larry Law Student or Frank French Fries, I wouldn't want them taking up the space and resources of the County when they can be better used against those who murder, maim, steal, etc.
Thankfully, LA County is exporting its most dangerous elements to neighboring Kern Count.

Crying out for her mother when she was ordered back to jail, Paris Hilton's cool, glamorous image evaporated Friday as she gave the impression of a little girl lost in a merciless legal system.

I just don't see how Lee Baca doesn't understand you have to follow court orders. The best part was how an undersherrif lied to the court about filing papers to get her released, and then did it without filing anything.
I'm not familiar with California law, but in the federal system, once the prisoner is handed of to FBP custody, there's little power for the judge. A judge can't order someone to serve in a prison in California, or in a maximum security prison, or not in a halfway house. Those are all decisions for the FBP. In this case, the LASD is in charge of the jail facilities. Whether they have the kind of discretion that the FBP has, I don't know, but they should.
It seems that the issue is unsettled. In fact, Paris Hilton's appeal might lead to some legal precedent.

Can't we just be happy she's in jail? I am taking pleasure in this (schadenfreude) and ignoring any and all legal issues.
If she had been released due to overcrowding, that would be one thing, but some crappy mental issue is another. Overcrowding, the Sheriff can do, due to federal court orders, etc. If she's nuts, he needs to send her to a shrink, who can then give her her happy meds. (Trust me, a big jail like LA has plenty of shrinks.)
What punishment is meted out for a probation violation can vary. It depends on the probation officer, the judge, and especially the probationer herself. The fact that this particular probationer offered such a cockamamie defense (it's my publicist's fault) might be worth a couple extra days, in my book.
Paris is a genius. She actually gets paid to attend grand-openings, parties, etc. this is only possible because of the image she has craftily created for herself. I can think of few, if any, persons who have done so much with so little - i.e., no real talent that we generally equate to other "celebrities," yet she has managed to ascend to the status of famed celebrity - she is now famous for being famous and continues to garner the country’s attention. I hear the groans: “She’s only famous because she comes from a rich family.” Simple statistics and a little logic illustrate that this cannot possibly be true. If it were, every spoiled daughter (or son) of a rich family would be famous. Whatsmore, it is my understanding that she has not accepted any money from her family since turning 18. That is impressive on its own in my book, but not only has she made it on her own, she has excelled. This country is fascinated with beauty, drama, and tragedy. Paris, in all her PR genius, has figured out a way to combine all three and the nation can’t get enough. Just when you think you have heard the last of Paris, she finds a way back into America’s conscience, which means she will continue to be paid for her special appearances- genius!
