BART Shooting Update

I suppose everyone has already heard that the former BART Officer was arrested in Douglas County, Nevada. As a well-placed source said, "well when they say they arrested someone in a given county, you get the idea that it's rural." Apparently, this is around the area of South Lake Tahoe. At first, I was puzzled why the officer would go to Nevada, but I guess the location sort of explains it.

More importantly, I couldn't help but notice the murder charge. I'm pretty sure no judge with a pulse will throw out the charge sua sponte. That only leaves the jury.

I know very little about criminal law, so maybe someone here can help me out. If the case does go to trial, can the defense try to/succeed at moving the trial out of Alameda?

Yes. There is a provision that allows for a trial to relocated to any other county in California to avoid bias/prejudice. The most recent example of that was Scott Peterson's trial moving from Stanislaus County to San Mateo. Before that, the state trial of the officers accused of beating Rodney King was moved from LA to Ventura County. Specifically to Simi Valley, which has something like a 50% law enforcement population.

What Armen said. If this case doesn't move to another county, the judge is an idiot. Alameda is in full angry-mob-mode on this one (although the protest today went smoothly and violence free, which is a welcome change.)

I think it is time for police officers to be treated the way the public gets treated. For far too long they have been getting away with murder, beatings, and other unlawful acts. Im not saying that the BART officer should be a scapegoat but it is obvious what he did was extremely wrong and it was caught on tape. Rodney King's beating was caught on tape and the officers got away with it, God willing that don't happen again. Also if he gets relocated most likely with government corruption and racism he will be relocated to a county that has a high number of caucasian residents, or in a county that could care less about another black boy dying.
