An Amendment To Be

Hmmm, now that the GOP leadership wants to take away one of the most fundamental rights enshrined by the 14th Amendment (jus soli citizenship) then Congressional Democrats should propose to tack on amendments to the amendment. 

1)  Eliminate incorporation of the 2nd Amendment through the 14th Amendment.

2)  Amplify first half of the 2nd Amendment and eliminate any personal right to keep and bear arms.

3)  Eliminate corporate political contributions from the ambit of 1A free speech. 

Deal?

I love the way the people continually fail to notice that our Constitution is a document chock full of really good ideas. Instead, they assume that if the Constitution forbids something they like, then it must be either Constitution or the Supreme Court that needs revision.

Wait, did I say I love the way people do this? I meant 'hate.'

At least people generally don't want to repeal the constitution in its entirety or some nonsense.

Patrick, to go along with the constitution being full of good ideas, it's useful in arguing with originalists or textualists that get upset that the constitution doesn't explicitly carve out the right to privacy to point out that a lot of stuff that they like (the right to raise your own children, the right to live with your family, etc.) is protected by the same right to privacy. This generally seemed to stump my grandparents anyway.

I'm not sure that corporate political contributions are covered by the First Amendment. Surely you can't be referring to Citizens United v. FEC, which protected corporate independent expenditures and not contributions.

I don't know if the young whippersnappers still read this blog. But maybe it will help some incoming 1Ls to start the start of Boalt thread.

I'll start the wisdom-impartation: Yes, 1L, you should wear a tie during first day. And make sure to bring the briefcase you just bought.

Yes, although Boalt may be a "clothing-optional" law school, that does not include the tie. Note, ascots are acceptable only on casual Fridays.
