Happy Halloween, N&B!!

It's gearing up to be a scary one indeed, between Kamala Harris's "Operation Boo" (requiring all registered sex offenders to stay inside their homes with outdoor lights extinguished during Halloween night, while transient sex offenders are rounded up and supervised between 5-10pm tonight) and the OWS Oakland general strike scheduled for this Wednesday that purports to "shut down the 1%" (Big Daddy Warbucks: "Haha. Ha. Hahaha." Small Business Owner in Oakland: "Oh s*@$!")

Good. Sex offenders have some of the highest recidivism rates, due in some measure to lax sentences in comparison to other crimes. While it's true that the current sex offender registration program is too broad, a vast majority of registered sex offenders are violent pedophiles who simply cannot be rehabilitated. On a night like Halloween, where the most vulnerable population is at the nadir of its vulnerability, I applaud this novel approach to reducing assault.

I wouldn't be surprised if property crimes and DUIs increase on Halloween. But chomo'ing? Seems dubious.

First of all, sex offenders have much stricter sentences in CA than other crimes. Two instances of penetration with someone under 14 will get you 15 to life.

Second, halloween is likely one of the safest for children as everyone is paying attention to the issue.

A vast majority of those registered are not, in fact, violent nor are the pedophiles. Urinating in public, public exposure, lewd acts in public can all be registerable offenses. 3:45, you clearly have no idea what you're talking about.

Plus, shouldn't that read "the most vulnerable population is at the zenith of its vulnerability"? Wouldn't the nadir of vulnerability be unassailability?

Also, why, when I search for sex offenders near me online, do nearly all of them show up as being convicted of sex crimes with minors or rape?

How is that harsh? Penetration with someone under 14... that sounds an awful lot like, um, what's that word? Rape.

I would be okay with 1 instance of penetration with someone under 14 leading to 15 to life.

CPC 290 lays it all out.

Non-violent and only statutorily coercive sex with a minor is much different than a violent assault, but the former carries more jail time than the latter.

Isn't the solution then to increase the sentence for a violent assault?

We, as a society, have decided that a person under 14 clearly lacks the ability to provide informed consent to sexual conduct. "Statutorily coercive" is really just a nice way of saying statutory rape.

The easy solution is... stop fucking molesting kids.
